Abogados que perdieron arbitraje en caso Vertedero Duquesa cobraron US$4 millones

Los gastos totales del juicio por vertedero de Duquesa son de 294 millones de pesos, así lo revela la investigación de Reporte Especial con Julissa Céspedes
DIARIO ULTRAMAR, SANTO DOMINGO, R.D.- En el reciente arbitraje internacional por los terrenos del vertedero de Duquesa interpuesta por la empresa Lajun Corporation la República Dominicana fue condenada a pagar una factura de más de 2,000 millones de pesos a favor de esa empresa.
Además, la estrategia de defensa y el juicio, que culminó con una derrota, generó un costo que superó los 294 millones de pesos.
Dentro de esos gastos que hizo el gobierno se incluye el pago de 4 millones de dólares correspondientes a los honorarios profesionales de la firma Curtis, Mallet-Prevost, Colt & Mosle LLP en las fases de jurisdicción y fondo. Y los gastos por el juicio totalizan 5 millones 882 mil 933 mil dólares, que, al convertirse al tipo de cambio, supera los 294 millones de pesos.
Una de las razones que motivó la elección de Curtis Mallet-Prevost, Colt & Mosle fue su experiencia en arbitraje y la reducción de su oferta económica a 2 millones 700 mil dólares para mayo de 2018. Al firmarse el contrato en 2019, se fijó el monto en un máximo de 3 millones 698 mil dólares.
Sin embargo, conforme al laudo final, se le terminó pagando a CURTIS a finales de 2023 la suma de 4 millones 238 mil dólares, una diferencia de más de un millón de dólares respecto a la propuesta inicial.
Pero, ¿cuál es el origen de la cuantía de la factura? Según la decisión del Tribunal, la República Dominicana, en calidad de demandada, deberá indemnizar a Michael Anthony Lee-Chin con 43 millones de dólares.

Los intereses se calculan de la siguiente manera: en relación con el monto correspondiente a los daños por la falta de actualización de las tarifas, se estipulan 4 millones de dólares desde diciembre de 2013.Asimismo, en lo que respecta a los daños sobre las acciones de Lajún, se establece la suma de 38 millones de dólares desde septiembre de 2017, alcanzando así un total de 43 millones 590 mil 90 dólares.
Para Waldys Taveras, director de la Mancomunidad Gran Santo Domingo, “se trata de una condena que llega a los 2,500 millones de pesos dominicanos. La razón por la que después de uno leer el laudo arbitral que él tenía, no la sentencia en materia de controversias, el laudo, uno tiene que llegar a la conclusión que una de las razones por las que y por la única que se condena el Estado dominicano es porque hay un lucro cesante del contrato de Lajun Corporation y el Ayuntamiento de Santo Domingo Norte”
A esto se le suma el costo asociado al arbitraje internacional, que se detalla en la Declaración sobre Costos presentada por la República Dominicana en el laudo final. Este desglose comprende 550 mil dólares para los costos del arbitraje por los servicios del Centro Internacional de Arreglo de Diferencias Relativas a Inversiones. Además, los honorarios del Tribunal, 61 mil 718 dólares para los gastos de las audiencias en dichas fases, y 500 mil dólares cada uno para los honorarios y gastos de los peritos de la República Dominicana, J.S. Held y Quadrant Economics LLC.

El fallo que condenó a la República Dominicana a una indemnización millonaria provino del tribunal compuesto por Diego Fernández Arroyo, actuando como presidente, junto a Christian Leathley y Marcelo Kohen como Árbitros. Kohen emitió un voto disidente, expresando sus desacuerdos con varios aspectos del laudo final y criticando puntos clave.
Los representantes dominicanos, ante la corte, incluyeron funcionarios de la Dirección de Prevención y Solución de Controversias de Industria y Comercio, así como representantes de entidades como el Ministerio de Medio Ambiente, la Consultoría Jurídica del Poder Ejecutivo, el Ayuntamiento de Santo Domingo Norte y la Procuraduría General de la República.
